From recent national legislation to the European Regulation

Packaging and packaging waste issues have historically been the focus of national and EU legislation. As is well known, at European level we had the Packaging Directive 94/62/EC (1), which has been a stable reference framework in this area for several decades and has allowed the consolidation of extended producer responsibility schemes for improving the collection and management of household packaging waste throughout Europe.

In 2022, the European Commission publishesd the Proposal for a Regulation of the European Parliament and of the Council on packaging and packaging waste, amending Regulation (EU) 2019/1020 and Directive (EU) 2019/904, and repealing Directive 94/62/EC. The process has been slow and complex and it is finally expected to be approved by the end of 2024* and published to enter into force in 2025. However, its obligations will only be enforceable 18 months after its entry into force and many of its requirements are, in turn, deferred to the adoption by the European Commission of a series of implementing or delegated acts, which means that its application (and its harmonising effect) is postponed considerably in time.
